Navigating the Aftermath: Legal Steps Following a Car Accident

In 2024, there were over 380,000 crashes in Florida, resulting in over 3,000 deaths and 246,000 injuries. Here in Hillsborough County, nearly 1,300 people died from 2012-2018 as a result of car accidents. While authorities in Tampa and Hillsborough County have recently implemented new safety measures and infrastructure improvements aimed at reducing auto accidents, crashes still occur far too frequently on Tampa area roads.

Recent Safety Improvements

In 2023, Tampa received $20 million to fund new infrastructure aimed at improving traffic and pedestrian safety, including upgrades to crosswalks, signals, lighting, bike lanes, sidewalks, and more. Hillsborough County also received nearly $20 million to install sidewalks, bike lanes, and other safety measures in 22 high-risk areas. Though positive steps are being taken, accidents still happen regularly.

If you are involved in a collision, it is important to know your legal rights and responsibilities to best protect yourself throughout the aftermath.

Report the Car Accident

If the crash results in injuries, deaths, or significant property damage, you must contact the police immediately. An officer will come to the scene to take statements, collect evidence, and file an official report. The police report will be a crucial piece of evidence if you take legal action later. Even for minor accidents, it is still wise to call the police to have documentation. If the vehicles can still be driven, move them out of the flow of traffic to a safe location like a parking lot. Exchange insurance and contact information with the other driver involved.

Document the Scene

While waiting for the police to arrive, photograph the accident scene from multiple angles. Take pictures of the vehicle damage, skid marks, debris, road conditions, and any environmental factors like weather or poor visibility that may have contributed. Also, photograph any injuries you sustained. These pictures can validate your account of how the crash occurred. Write down your recollection of events as soon as possible while your memory is fresh.

Consult a Car Accident Attorney

Speaking with an experienced car accident attorney is highly recommended, even if the crash seems minor. An attorney can deal with the insurance companies on your behalf while you focus on recovery. They will determine the settlement amount you deserve based on the severity of your injuries, vehicle damage, lost income, and other accident-related costs. If the insurance company does not offer an adequate settlement, the attorney can help you pursue compensation through a personal injury lawsuit. Contingency fee agreements mean you only pay legal fees if you recover damages.

Preserve Evidence

Do not throw away or repair anything damaged in the collision until your claim is settled. The vehicles involved should remain in their post-accident condition in case insurance inspectors need to assess them. Keep the clothes you were wearing at the time unwashed. Save text messages, social media posts, or notes from witnesses. If the accident involved a commercial vehicle like a big rig or company car, request to preserve any dash cam or electronic logging device footage.

Comply with Insurance Requests

You must cooperate fully with your insurance company’s investigation. Provide a recorded statement about the accident if requested. Turn over any evidence you collected, including photos, videos, medical records, and bills. Complete any necessary paperwork promptly. Failure to comply could delay or jeopardize your claim. However, avoid signing any documents the insurer sends or accepting a settlement offer without your attorney reviewing them first.

Following these steps will help ensure you receive fair compensation for your injuries, vehicle damage, and other losses resulting from the crash. With the proper diligent preparation, you can achieve the best possible outcome and recovery from your accident.
